In a recent case our team at the Law Office of Chip Siegel handled, a client came to us after they were accused of kidnapping and domestic violence strangulation. These were extremely serious allegations because a conviction of kidnapping can result in a mandatory prison sentence. Under Nevada law, an individual could be accused of either first or second degree kidnapping. First degree kidnapping occurs when the victim was being held for ransom, the kidnapping occurred for the purpose of committing sexual assault, or the victim suffered physical harm as a result. Any other type of kidnapping case is considered second degree.
Under Nevada law, strangulation in a domestic violence case could be charged as a category C felony. After being able to prove that the victim was misrepresenting evidence, the entire case was dismissed.
